Terms of Service

1. Acceptance & Operational Scope

By accessing or utilizing the Observyze platform, SDKs, or Proxy Gateway services, you enter into a binding agreement governed by these Terms of Service. Observyze provides real-time telemetry capture, execution budget enforcement, prompt evaluation, and circuit breaker infrastructure for production AI systems.

You represent that you have the organizational authority to bind your entity to these terms and that your configuration of AI agents complies with all applicable local, regional, and international regulations.

2. Account Security & API Key Custody

Customers are responsible for maintaining the confidentiality of their account credentials and generated project API keys. Observyze provides encrypted secret storage using AES-256-GCM for upstream provider credentials.

You must notify Observyze immediately upon discovering any unauthorized key exposure or compromised deployment credentials. Observyze cannot be held liable for damages or unauthorized upstream compute charges resulting from compromised credentials maintained outside our infrastructure.

3. Fair Usage Policy & Capacity Management

To preserve high availability and ultra-low latency for all production tenants, Observyze enforces fair usage thresholds across telemetry ingestion endpoints, WebSocket streaming connections, and asynchronous evaluation pipelines.

We reserve the right to throttle or rate-limit ingestion streams that demonstrate unnatural traffic spikes, intentional flood patterns, or uncoordinated load testing that threatens cluster stability. Customers requiring dedicated multi-region throughput are encouraged to engage our enterprise solutions team.

4. Customer Telemetry & Data Sovereignty

You retain all right, title, and interest in and to any prompt data, completion responses, span metadata, and configuration parameters transmitted to Observyze. Observyze processes telemetry exclusively to provide observability, monitoring, and policy enforcement services.

Zero Model Training: Observyze does not use customer telemetry, prompts, completions, or evaluations to train, fine-tune, or improve internal or third-party foundational models.

5. Runtime Control & Performance Disclaimers

Observyze provides tools designed to mitigate runaway execution loops, detect prompt injections, and evaluate model grounding. However, because generative AI systems operate probabilistically, Observyze does not guarantee that runtime circuit breakers or guardrails will intercept every failure mode or hallucinated response.

The platform is provided on an "as is" and "as available" basis. Customers remain ultimately responsible for testing, validating, and monitoring the safety and business logic of their autonomous AI agent systems.

6. Term, Suspension & Termination

Either party may terminate this agreement at any time upon notice or through the console interface. Upon termination, access to the platform will conclude at the end of the paid billing period, and telemetry retention policies will govern data purging as specified in our Privacy Policy.
